Council of State backs KSA over Holland Casino website navigation

Enforcement & compliance

The Netherlands’ Council of State ruled in favour of the Kansspelautoriteit in Holland Casino’s appeal over website navigation and a penalty order imposed in December 2021. The court rejected the company’s arguments that navigation buttons were not advertising, that the sanction was unsuitable and that its earlier pop-up choice complied with the rules.

The ruling clarifies that navigation directing users to physical casino information can count as advertising under the KSA’s approach.

The Council of State has left in place the Rechtbank Midden-Nederland ruling on Sabofra's application for a new slot-machine licence. The refusal of the licence is therefore final in this administrative procedure.
