Council of State upholds €350,000 Bingoal fine over Cruks checks

Enforcement & compliance

The Netherlands’ Council of State upheld the Kansspelautoriteit’s €350,000 fine against Bingoal over admissions made while its Cruks access certificate had expired in June 2022. Five players registered in Cruks were able to gamble during the period; the court found the technical-failure exception did not apply because Bingoal lacked a valid certificate.

The ruling confirms the fine and clarifies that an operator’s expired certificate does not qualify as a Cruks system outage.
