Italy’s Council of State refers Global Starnet tax dispute to EU court

Regulation

Italy’s Council of State has referred Global Starnet’s dispute with the Customs and Monopolies Agency over VLT tax increases to the Court of Justice of the European Union. The referral asks whether successive legislative increases in the PREU rate, from 4% to 8.6% over about 12 years, comply with EU law. Global Starnet says it invested nearly €180 million and is seeking compensation for the higher charges.

The referral could affect how VLT tax increases are assessed against operators’ claims about their investments and regulatory expectations.
