Italy’s Constitutional Court allows reductions to gambling-advertising penalties
Italy’s Constitutional Court ruled that the €50m minimum penalty for each breach of the gambling-advertising ban must be reducible when its application is manifestly disproportionate. It said authorities must consider the breach’s seriousness, efforts to mitigate its effects, the offender’s character and financial circumstances. The ruling arose from an AGCOM penalty of 157m euros that remains under challenge before the Lazio Regional Administrative Court.
Operators and advertisers face penalties that can be adjusted to reflect the circumstances and financial position of the offender.
