EU court limits operators’ rights to seek concession changes in Italy
The Court of Justice of the European Union ruled on a reference from an Italian court concerning Cirsa Italia’s concessions for managing Italy’s gaming-machine network. It said EU public-concessions rules apply to older contracts later extended under national law, but do not require authorities to open a review process when unforeseen events alter a concession’s economic balance. The Italian court will apply that interpretation when deciding the underlying dispute.
Operators in Italy cannot rely on EU rules to require an automatic review of concession terms after unforeseen economic changes.
