EU court applies player’s home-country law to losses at unlicensed casinos
The Court of Justice of the European Union ruled in the Wunner case that claims over gambling losses at an unauthorised casino are governed by the law of the player’s habitual residence. The case involved an Austrian resident seeking €18,547.67 from the directors of Malta-based Titanium Brace Marketing Limited over losses incurred in 2019 and 2020; the company had a Maltese licence but no Austrian authorisation.
Operators and directors may face claims under the law of the market where a player habitually resides.
