EU court allows players to rely on home-country law in claims against unlicensed casinos
The Court of Justice of the European Union ruled that players may generally invoke the law of their country of residence in non-contractual liability claims against foreign gambling providers operating without a required licence. In a case involving an Austrian customer and a Maltese operator, the court said the damage occurred where the player habitually resides, while allowing another country’s law where links to it are manifestly closer.
The ruling may affect the law applicable to claims against unlicensed gambling providers operating across borders.
