Dutch Supreme Court rejects automatic refunds for unlicensed gambling losses
The Netherlands’ Supreme Court ruled on 3 July that contracts with online gambling operators lacking Dutch licences are not automatically void under civil law. The preliminary ruling concerned claims against TSG Interactive Gaming Europe and Electraworks Europe, including losses of $139,464.58 and €135,137. The court said claims may still be assessed under other civil-law grounds, depending on the facts.
Operators face continuing individual claims, but players cannot rely solely on contracts being automatically void.
