Illinois court bars state gambling rules for Kalshi

Regulation · SectorWire deskSource published 2 min read

A federal district court in Illinois has barred the state from applying its gambling regulations to Kalshi. Judge Martha Pacold ruled that the Commodity Futures Trading Commission (CFTC), rather than state regulators, oversees prediction markets, the report said. The decision does not settle the nationwide dispute over sports event contracts.

At the heart of the fight is a classification question: do sports event contracts belong to federal derivatives supervision, or to state gambling law? The CFTC's current oversight of prediction markets rests on the federal Commodity Exchange Act, whereas Michigan and other states contend that sports contracts amount to sportsbook wagers. Kalshi and fellow prediction-market operators reject that framing, describing the contracts as swaps instead of conventional bets and pointing to their economic effects as the reason they sit inside the CFTC's federal remit.

Among the states, Michigan has been one of the most aggressive challengers, taking Kalshi to court in March. Since then the company has geofenced its sports markets so that Michigan customers cannot access them, a model the source says has been applied elsewhere too. Coinbase took a different route in the same state, halting its sports event contracts in Michigan once it reached an agreement with state gaming regulators.

Kalshi chief executive Tarek Mansour, addressing DC Fintech Week 2026, said he was confident about where Kalshi stands in its continuing legal battles. At the same time, he conceded that a win for state regulators might push prediction-market operators to relocate their business offshore instead of operating under state control. Mansour's preference, he has said, is a single uniform federal rule rather than a fragmented patchwork.

According to TheLines on October 19, the final word on how platforms like Kalshi, Polymarket and Underdog are regulated may rest with the US Supreme Court. That report also observed that even after Kalshi's win in Illinois, platforms might still owe state taxes on future profits. Commercially, Kalshi's reach includes partnership deals with Madison Square Garden and several sports franchises, among them five Major League Baseball teams.

Running offshore, the report said, might let an operation escape the attention of state gaming authorities like the New Jersey Division of Gaming Enforcement and the Pennsylvania Gaming Control Board, though what that would mean for Kalshi's US business is still unclear. Whether the industry stays under federal oversight or comes under wider state control is the next decisive question.
