Dutch Supreme Court rules pre-2021 player loss claims not automatically void
Regulation · SectorWire deskSource published
Summary
The Supreme Court of the Netherlands has ruled that gambling contracts with unlicensed operators made before the market was regulated in 2021 are not automatically void. The decision followed preliminary questions from the District Court of Amsterdam and the District Court of North Holland in cases involving two players who lost $139,464.58 and €135,137. Entain welcomed the ruling, saying historic losses cannot be recovered on that basis.
Why it matters
The ruling limits restitution claims against unlicensed operators for pre-2021 losses, reducing legal exposure for operators facing similar cases in the Netherlands.
