EU Court clarifies hosting protections for videos advertising online gambling
The Court of Justice of the European Union ruled on 16 July 2026 in a case referred by Italy’s Council of State involving AGCOM and Google Ireland. It said video-hosting services remain within the E-Commerce Directive even when hosted videos advertise gambling, but a platform that actively assesses channel content under a revenue-sharing partnership cannot rely on the directive’s liability exemption as a neutral intermediary.
The ruling clarifies when video platforms may lose liability protections for gambling advertising hosted on their services.
