Dutch Supreme Court upholds validity of pre-regulation gambling agreements

Regulation

The Supreme Court of the Netherlands ruled that agreements between online gambling operators and customers made before regulation remain valid. The cases concerned play under the former Games of Chance Act, before the Remote Gambling Act took effect in October 2021; the court found no basis to treat those transactions as invalid. Entain said the ruling confirmed its position that historic losses cannot be recovered on that ground.

The ruling rejects a basis for players to recover historic losses from operators over pre-2021 agreements.
