Advocate General questions Malta’s Bill 55 under EU law

Regulation

Advocate General Nicholas Emiliou said the Austrian court’s referral concerning Malta’s Bill 55 may be inadmissible because the dispute centres on legal advice, not the law’s compliance with EU rules. He added that, if the Court of Justice considers the merits, the provision would be incompatible with the Brussels I bis Regulation; the court has not yet issued its decision.

The opinion signals that Malta’s provision may conflict with EU rules, potentially affecting enforcement of player-recovery judgments.

The court dismissed the action and ordered the parties' legal costs to be offset.
