State advocate defends €50,000 minimum gambling-advertising fine in court

Regulation

State advocate Melvio Maugeri defended Italy’s €50,000 minimum penalty for unlawful gambling advertising during a Constitutional Court hearing, according to the report. He argued that the penalty, set at 20% of the economic value of the advertising or sponsorship subject to a minimum, is proportionate and serves public-health protection. The court was considering the constitutionality of Article 9(2) of the 2018 decree-law.

The ruling could affect the minimum penalty applied to breaches of Italy’s gambling-advertising ban.
