Sixth Circuit upholds injunction protecting TwinSpires in Michigan licensing dispute
The US Court of Appeals for the Sixth Circuit upheld a preliminary injunction barring Michigan’s gaming regulator from enforcing state horse-racing licensing rules against TwinSpires, according to its 16 December opinion. The court said Churchill Downs was likely to show that the federal Interstate Horseracing Act pre-empts Michigan’s requirement for a third-party facilitator licence; the case remains ongoing.
The ruling allows TwinSpires to continue operating in Michigan while the dispute over state licensing authority proceeds.
