Sixth Circuit allows Ohio and Tennessee gambling enforcement against Kalshi

Regulation

The US Court of Appeals for the Sixth Circuit ruled that Kalshi’s sports-related event contracts did not meet the statutory definition of swaps under the Commodity Exchange Act. The court also found that the Act did not pre-empt Ohio or Tennessee gambling laws, allowing those states’ regulators to pursue enforcement against Kalshi and other prediction-market operators.

The ruling permits Ohio and Tennessee regulators to apply state gambling laws to sports-event contracts.
