Ninth Circuit rejects Kalshi rehearing request in Nevada case
The Ninth Circuit Court of Appeals unanimously rejected Kalshi’s requests for a panel rehearing and a rehearing en banc, leaving in place a ruling that allows Nevada gaming regulators to pursue enforcement. Kalshi has 90 days to ask the US Supreme Court to review the case. The ruling follows a 3 November Second Circuit decision denying Kalshi’s request to temporarily block New York and Connecticut officials from enforcing gambling laws on sports event contracts.
The decision leaves Nevada regulators able to pursue enforcement against Kalshi’s sports event contracts.
