Ninth Circuit questions Kalshi over contracts on tribal lands

Regulation

A Ninth Circuit panel questioned Kalshi during an appeal by three California tribes seeking to revive their request for a preliminary injunction. The tribes argue the sports-event contracts constitute unauthorised Class III gaming on tribal lands under the Indian Gaming Regulatory Act; Kalshi disputes whether the law gives tribes a claim against a private company. The court has set no decision deadline.

The appeal could clarify whether tribal gaming law applies to Kalshi’s sports-event contracts placed on tribal lands.
