Italy's Agenzia delle Entrate creates tax code 8985 for entertainment duty penalties

Regulation · SectorWire deskSource published 2 min read

Italy's Agenzia delle Entrate has established a new tax code for payments of penalties relating to the entertainment duty (ISI), under the rules on cooperative correction and legal cumulation. The code was created by resolution 38/E of 23 October 2026, according to the resolution.

The code is 8985, named "Sanzione unica da ravvedimento imposta sugli intrattenimenti – articolo 13, comma 2-bis, del d.lgs. 18 dicembre 1997, n. 472". The resolution implements changes introduced by article 3 of legislative decree 87/2024, which provided for legal cumulation to apply in cooperative correction as well. Under the mechanism, a single penalty may be determined where several violations occur, instead of necessarily adding up the individual penalties. The single penalty is determined separately for each tax, tax period and instrument used for regularisation, and the reduction percentage for cooperative correction is identified by reference to the first violation.

Payment is made using the F24-Accise form, in the section for excise, monopolies and other payments not admitted to offsetting. The taxpayer must enter code M in the "ente" field, 8985 in the tax code field and the reference year in AAAA format in the "anno di riferimento" field, with the amount shown in the "importi a debito versati" column. The measure also concerns operators in the sector of amusement machines and entertainment activities subject to the duty, the report said.
