CJEU advocate general finds Malta’s Bill 55 referral inadmissible

Regulation

CJEU Advocate General Nicholas Emiliou said an Austrian court’s request for a preliminary ruling on Malta’s Bill 55 was inadmissible. He also said the measure would be incompatible with EU law if the court examined its substance; his opinion is non-binding, and the judges will decide the case. The opinion concerns Article 56A of Malta’s Gaming Act, which limits enforcement of certain foreign judgments against locally licensed operators.

The non-binding opinion raises uncertainty over whether foreign judgments can be enforced against Malta-licensed operators.
