The Amapá state government has suspended its tender for the concession of state lottery services, which had been scheduled for 27 October, according to a suspension notice. The decision was taken to bring the tender terms into line with Provisional Measure 1.394/2026, which prohibits fixed-odds betting in Brazil. No new date has been set for the auction.

The suspension was announced on 26 October by the Secretaria de Estado de Compras e Licitações Sustentáveis (SECCOMPRAS), after it examined a request for clarification that identified the need to revise the competition rules. The tender document is to be adjusted to comply with federal legislation.

Electronic Competition 037/2026 provided for the concession of the state's lottery services for 20 years, with the possibility of extension for an equal period. The project had an estimated value of R$22.56m and required a minimum fixed grant of R$2.6m from the winning company.

The process covered the implementation and operation of six lottery modalities: passive lottery, numerical prognostics, specific prognostics, sports prognostics, exclusive instant lottery and fixed-odds betting. The concessionaire would be responsible for selling the products through physical and digital channels, including setting up points of sale, a virtual platform, holding draws and paying prizes.

The main obstacle arose because the terms of reference required the winning company to operate all the modalities included in the contract, among them fixed-odds betting. MP 1.394/2026, issued on 25 September, prohibited the operation, offering, intermediation and advertising of that modality in national territory, and also covers authorisations granted by the states and the Federal District.

The competition was initially scheduled for 13 July and went through successive postponements. The tender document was republished in August. According to the suspension notice, if the government decides to continue the process, the new date will be published officially in line with the publicity requirements of Law 14.133/2021. There is currently no forecast for resumption.
