Amapá's state government is due to hold an electronic auction on 27 October for a 20-year concession to run the state's lottery services, according to a notice published in the Diário Oficial da União. The tender, Concorrência Eletrônica nº 037/2026, is run by the Secretaria de Estado de Compras e Licitações Sustentáveis (SECCOMPRAS/AP), with the Secretaria de Estado da Fazenda (SEFAZ/AP) as the granting authority. Bids close at 08:29 Brasília time, opening is scheduled for 08:30 and the dispute begins at 09:00 on the SIGA system.

The estimated value of the contract is R$22,562,433.90, based on August 2025, covering the investments to be made by the concessionaire including the minimum fixed grant. The minimum fixed grant is R$2.6m, and the winner will be the bidder offering the highest fixed grant in an open dispute with rising bids and a minimum interval of R$10,000. The fixed grant must be paid before the contract is signed and is adjusted by the IPCA. The concessionaire will also pay a monthly variable grant and a management charge, both calculated on GGR, with percentages set by Decreto Estadual nº 2.486/2025 and the contract. Prizes not claimed within the deadline will be transferred to the state in the following variable grant payment.

The concession covers the implementation, management and operation of lottery modalities instituted by the Union, in physical and digital form. The concessionaire will be responsible for creating and selling lottery products, setting up the sales network and virtual platform, carrying out communication and advertising, conducting draws and paying prizes. The notice lists six modalities: passive, numerical prognostics, specific prognostics, sports prognostics, exclusive instant and fixed-odds. Under the terms of reference, the concessionaire must operate all lottery modalities in the concession's scope, including fixed-odds betting.

The concession runs for 20 years from the date the contract takes effect. It may be extended for an equal period in the public interest, and also for economic-financial rebalancing or to ensure continuity of the service. The contract is subject to a mandatory review every five years.

National or foreign companies may take part, alone or in a consortium. The winner must set up a Sociedade de Propósito Específico (SPE) with headquarters or a branch in Amapá. Requirements include at least 12 consecutive months operating at least one lottery modality in a regulated environment, liquidity and solvency ratios of 1 or above, net equity of at least 10% of the estimated value, and a performance guarantee of R$2,256,243.39.

The concession follows a two-layer model. The management layer stays with the state and runs on a platform supplied at no cost by the concessionaire (SaaS), installed in a situation room at SEFAZ. The operational layer stays with the concessionaire and covers the lottery platform, the physical network, bettor support and responsible gambling mechanisms. Supervision falls to the granting authority or the Agência Reguladora de Serviços Públicos Delegados do Amapá (ARSAP), with support from an independent verifier. After signing, the concessionaire must submit management and operation, responsible gambling, territoriality and compliance plans, plus initial lottery plans including a fixed-odds betting plan. Once the plans are approved, the Termo de Outorga will be signed, and commercialisation must begin within 60 days of that signature.

The tender was originally scheduled for 13 July. After postponements and a republication of the notice in August, it was moved to 20 October and then to 27 October. The latest notice, published in the Diário Oficial da União, also corrected the tender number, which had appeared as 027/2026. The tender is based on Lei Estadual nº 3.126/2024 and Decreto Estadual nº 2.486/2025, and the notice and annexes are available on SIGA and the Portal Nacional de Contratações Públicas (PNCP).

On 2 October, Prohards Comércio, Desenvolvimento e Serviços em Tecnologia da Informação Ltda., of Rio Claro (SP), sent a clarification request to SECCOMPRAS. The company cited Medida Provisória nº 1.394/2026, which prohibits the exploitation, offering, intermediation and advertising of fixed-odds betting in national territory, and asked whether the notice was still active or could be cancelled or postponed. As of the afternoon of 20 October, the request was listed on the tender page on SIGA with the status awaiting response. Under the notice, clarification requests must be answered within three working days, and the answers published in the system bind participants and the administration.
