Italian tax court rejects online gambling operator’s €1.5m tax refund claim

Regulation

An Italian first-instance tax court rejected an online gambling concessionaire’s request to recover more than €1.5m in tax paid from December 2021 to December 2022, according to the report. The dispute concerned whether a 25% rate applied to remote fixed-odds games and non-tournament card games; the court treated a 2025 provision applying that rate to those games as interpretative and applicable to the earlier period.

The ruling supports applying the 25% rate to these remote games for the disputed earlier tax period.
