FEBRALOT seeks participation in Brazil Supreme Court lottery hearing

Regulation2 min read

FEBRALOT asked Brazil’s Supreme Federal Court to admit it as an amicus curiae in ADI 8.027 and, if feasible, let it take part in a public hearing scheduled for 3 November. The federation said the deadline for submitting representatives’ details had passed, and asked the court to consider its written submission if it could not attend.

Direct Action of Unconstitutionality no 8.027 is pending before the Supreme Federal Court, and FEBRALOT, the Brazilian Federation of Lottery Companies, hopes to take part in the debate on it. The entity has asked rapporteur Luiz Fux to admit it as amicus curiae. It also asks, as an exception, for authorisation to attend the public hearing foreseen for 3 November. The federation acknowledges that the deadline for sending the names and powers of attorney of the participating entities' representatives ended at 15h on 29 October. Because of that, it asks that its participation count only if it is still operationally feasible, and at the rapporteur's discretion. If attending the hearing is not possible, the federation wants its written statement and documents to be received, without prejudice to the review of the amicus curiae admission request.

The entity's members are lottery businesses that make up an in-person service network with national reach. Per the federation's own estimate, the activity supports "cerca de 80 mil famílias", both directly and indirectly.

The federation intends to bring to the debate the lottery companies' view on the sustainability of the network, changes in consumer habits, and the economic and social effects of the measures discussed in the case. FEBRALOT also points to the contribution of lottery products to social causes, including Olympic sport. It argues that the sector's development should preserve a competitive environment with clear, predictable and equal rules for all participants. On bettor protection, the federation argues for clear and equal rules for operators, set and supervised by the competent authorities.

FEBRALOT president Ricardo Amado Costa said the experience of those working in the lottery network should be considered in a discussion that may affect companies, workers and citizens who depend on the service. He said the federation wants to contribute sector information and take part in a balanced dialogue that also considers competition and the diversity of participants.

Authorisations for 85 betting companies, covering 188 brands, expire on 25 October under provisional measure 1.394/2026, the report said. Justice Luiz Fux is expected to consider challenges after the election; the Supreme Court could uphold the measure, suspend it or distinguish between sports betting and online casino games.

Authorisations held by 85 betting companies, covering 188 brands, expired on 25 October after the 30-day period set by provisional measure 1.394/2026 ended, according to the report. The measure, published on 25 September, prohibited fixed-odds betting and its advertising. The authorisations had been granted by the Secretariat of Prizes and Betting of the Ministry of Finance (SPA/MF). Fees paid by the companies will not be refunded.
