European Court of Justice due to rule in Malta-Germany gambling case

Regulation

The Court of Justice of the European Union is expected to rule on 16 April in case C-440/23, concerning German players’ claims against Malta-licensed online gambling companies. The companies argue that Germany’s restrictions conflict with EU rules on services and that the refund claim abuses EU law. The Advocate General’s opinion says Maltese courts may assess the relevant German rules and that EU law does not itself bar consumers from seeking refunds under national law.

The ruling could affect similar refund claims in Germany and Austria against Malta-licensed operators.
