The CFTC released an interim final rule and a separate proposal on Friday to clarify how sportsbook wagers and exchange-traded event contracts are treated. The interim rule excludes certain casino-style products offered under state or tribal law; the proposal would include event contracts linked to sports, politics, culture and weather in the definition of a swap. Kalshi cited the measures in a petition seeking reconsideration by the Sixth Circuit.
Two rulemakings were issued by the Commodity Futures Trading Commission (CFTC) on Friday, the agency said, in an effort to draw a line between a wager placed at a licensed sportsbook and a contract on the same outcome traded on a prediction market. Under one of them, casino-style gambling products allowed by state or tribal law are excluded, provided they are not traded on a regulated exchange. The other, a separate proposal, would explicitly classify event contracts tied to sports, politics, culture and sports as swaps.
