Brazil's AGU plans appeal against CDA Gaming injunction

Regulation1 min read

Brazil's Advocacia-Geral da União (AGU) said on 6 November it intends to challenge an injunction granted to CDA Gaming by the Federal Regional Court of the 3rd Region. The ruling provisionally allows CDA Gaming's brands to operate until a further court decision. The judge said the measure lacked provisions for returning the R$30 million licence payment or compensating affected operators.

Brazil's Advocacia-Geral da União (AGU) said it will contest the injunction granted to CDA Gaming by the Federal Regional Court of the 3rd Region (TRF-3). In a note, the AGU said it intends to appeal the ruling of federal appeals judge Adriana Pileggi.

Under the injunction, CDA Gaming's brands are provisionally authorised to operate until there is a new court ruling on the case. The judge argued that the absence of any provision for returning the R$30m paid for the licence, or for compensating operators affected by the provisional measure, amounts to a genuine confiscation.

The AGU took a position against maintaining the regulated betting market at a Supreme Federal Court public hearing on Provisional Measure 1.394/2026, held on Tuesday 3. The AGU's statement comes amid questions over the transparency of how the measure was drawn up. The government imposed five years of secrecy on the documents behind the measure.

Fellipe Fraga, an executive in the regulated betting market, said he received news of the secrecy order with deep concern. Fraga said the lack of transparency over the reasons for the decision could create legal uncertainty and favour illegal operators.
